NDP supporter ordered to pay $7,330 after making series of illegal donations to party

Dennis Theman donated over four times the legal limit to NDP riding associations around the 2015 federal election and exceeded donation limits again in 2017

OTTAWA – An NDP supporter must pay $7,330 after the federal elections watchdog caught him making a series of illegal donations to the party and various leadership candidates between 2015 and 2017.

According to a compliance agreement published Friday by the Commissioner of Canada Elections, Dartmouth, N.S., resident Dennis Theman donated $6,600 to no less than seven NDP riding associations in Nova Scotia and Ontario as well as four candidates for the NDP in the weeks before and after the 2015 federal election.

That’s over four times the legal limit of $1,500 in total donations to any number of riding associations or candidates of a federal party at the time, according to the commissioner’s office.

Then in 2017, Theman once again busted legal donation limits by $730 through gifts to the leadership campaigns of Charlie Angus, Niki Ashton, Guy Caron and Jagmeet Singh, the commissioner’s office details.

According to the commissioner as well as the NDP, the party has already returned the vast majority of those illegal donations to Theman.

But far from being able to keep the sums, the NDP supporter will have to pay the totality of the excessive donations as well as a fine to the government.

“As part of the terms and conditions of the compliance agreement, (Theman) agreed to pay a sum of $7,330 to the Receiver General of Canada, of which $5,830 represents the total illegal contributions and $1,500 ensures future compliance,” reads the commissioner’s release.

Theman is a retired senior crown attorney for Nova Scotia’s public prosecution service and unsuccessfully ran for the federal NDP in 1979, 1980 and 1984. He later became the provincial secretary for the Nova Scotia NDP between 1987 and 1990.

Theman has also been a regular and generous contributor to the party’s coffers. According to Elections Canada records, Theman has given thousands of dollars to the NDP through over 100 donations since 2014.

Between 2008 and 2014, a person with an identical name but living in Toronto is recorded to have given multiple thousands of dollars more to the NDP.

In a statement, the NDP said that any donations that exceed the legal limit are generally caught at the end of each year and then returned to the donor, such as in this case.

By signing a compliance agreement, Theman thus avoided any potential criminal proceedings. “No record of conviction is created as a result of admitting responsibility for acts that could constitute an offence,” says the commissioner’s release.
